Revisiting RA 8749

Underlying Section 16 Article 2 of the Philippine Constitution which states that
“The State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.” RA 8749 or the Philippine Clean Air Act of 1999 was created and successfully came into effect. It was almost nine years since the law was implemented. The law mainly addresses the environmental problem which is AIR POLLUTION, its effect on the environment and on every human’s health.
According to World Bank study in 2003, respiratory illnesses like bronchitis due to particulate emissions generated by vehicles and factories caused the high mortality rate and morbidity in the Philippines. It further announced that 80% of air pollution is generated by motor vehicles.
Under its “Declaration of Principles” the law/state explicitly recognized the principle that “POLLUTERS MUST PAY”. It also recognizes THAT A CLEAN AND HEALTHY ENVIRONMENT IS FOR GOOD OF ALL AND SHOULD THEREFORE BE THE CONCERN OF ALL.


While away from my home I tried to figure out why can't I get off my hanky from covering my nose.

So many laws but so many of these laws are poorly enacted and enforced. That's one of the many sad realities in this nation, apart from a Garcified leadership, an illegitimate one for that matter.

Whats new with Philippine laws? They are all written, and in the papers they must stay! There is no one law in the Philippines that is properly implemented and benefits the masses.

Hi, it will all be resolved as the oil runs out, or before that, gets too expensive for common use. The Phils is fairly well positioned with lots of agriculture, and jungle to turn over to food production, and a non mechanized farming methodology. Ang tanong,naipapatupad ba ito? Sa totoo lang, meron bang konstitusyon ang Pilipinas? Parang wala yata akong nakikitang ipinapatupad?

we have what we called dead provisions in our constitution because no one seems to utilize them.

its just sad that this provision, although how important it may seem, is categorized as such. now... that's saddening.

then what do these government agencies doing? they were mandated by law to implement these laws but obviously no improvements can be seen. where did they spent the budget of Clean Air ACt?

grabe huh....kaya as much as possible ayoko tumira sa city dahil sa pollution eh. anyway, that's the problem with Phils. Too many laws, yet only few are implemented and maintained. Magaling kasi sa NINGAS COGON. That makes more people disappointed with the gov't.
